Producers who hold a life line of authorikty as of the effective date must complete a one-time 4-hour annuity training course before 7/1/2017, while producers and brokers licensed after that date must complete the course before representing annuities. Producers must also be in compliance with the represented carrier's product training requirements.

Arizona - All Arizona annuity producers must complete a 4-hour annuity course and satisfy insurer product training requirements before representing annuities as of 12/31/2017. The state is "re-categorizing" suitability in annuity courses that had previously been approved for continuing education credit prior to the implementation of the rule; however, course numbers will not change, meaning that courses completed prior to the May 1st implementation date may not be accepted by carriers.

California - As of 1/1/2005, all brokers/producers are required to complete an initial 8-hour course before representing annuities, followed by a 4-hour course during each subsequent license term. In early 2011 the state made some minor changes to its ongoing (4 hour) training requirement which may allow carriers to consider four-hour CA completions to be reciprocal to states that have implemented training requirements based on the 2010 Suitability in Annuities NAIC Regulation; however, these changes appear to be a one-way door (in other words, all resident and non-resident CA producers must still complete a CA course every licensing term whether or not a 4-hour course is completed in another licensed state).

California courses are not eligible for ClearCert Certification at this time as the producer is directly responsible to the state department for compliance (instead of the insurance carrier, as with the 2010 Regulation).

Illinois - Illinois has added mandatory training for annuity producers to the state's insurance code.  Current producers have until 7/1/2012 to complete a one-time 4-hour annuity suitability course.  Those licensed after that date must complete training before representing annuities. The code states that brokers representing annuities with long term care benefits must also comply with the state's LTCI training requirement.

Brokers and producers must also be in compliance with the insurer's standards for product training.

Louisiana - All Louisiana annuity producers licensed prior to August 15, 2012 must complete a one-time four credit course no later than January 1st, 2013. Producers and brokers licensed after that date must complete a course before representing annuity products.

Although the state's new law follows the language of the 2010 NAIC Regulation in most respects, the full text of HB 1177 reveals two unique aspects. Providers are admonished to issue certificates of completion in accordance with existing state regulations (..."shall issue certificates of completion pursuant to LAC 37:XI.701", and carriers must validate producer compliance by "...obtaining certificates of completion of the training course by the insurance producer or by obtaining reports provided by commissioner database systems." This is a narrower validation process than set forth under the language of the 2010 Regulation, and seems designed to exclude electronic reporting that is not provided directly by the state. The Regulation's language regarding validation is: "An insurer may satisfy its responsibility under this subsection by obtaining certificates of completion of the training course or obtaining reports provided by commissioner-sponsored database systems or vendors or from a reasonably reliable commercial database vendor that has a reporting arrangement with approved insurance education providers" (emphasis added). Annuity issuers that use a commercial database vendor are strongly encouraged to maintain records of original certificates of completion.

Texas - Texas House Bill 2277F introduced a number of changes to the state's former annuity training requirement that make it largely compatible with the 2010 Model Regulation, including insurer responsibility for validating broker compliance with state and carrier product training. These changes make the requirement compatible with the Regulation, so Texas has been added to the states administered by ClearCert.

Additional guidance is expected that may have an impact on the transition to the new requirement. For example, after completing an initial 4-hour course 8 hours worth of training "that specifically relates to annuities" must be completed during each licensing period. Virginia - Virginia's Suitability in Annuities training requirements is effective April 1, 2017. Existing producers have until 1/1/2018 to complete a one-time 4 hour annuity course; producers hired after 1/1/2018 must complete a course before representing annuities.

Virginia residents must complete Virginia courses - even those who previously completed a course in a non-resident state that previously adopted the requirement. Virginia courses must be completed on 4/1/2017 or later to be valid toward meeting the requirement. Non-residents may complete a course in their resident state that has adopted a training requirement based on the 2010 Suitabity in Annuities regulation.

Washington - Annuity producers in the state licensed prior to the requirement's effective date must complete a four-hour suitability in annuity CE course by 9/29/2012. Producers licensed after that date must complete a course before representing annuity products. Note: Courses must be completed after the effective date of the regulation. The state has assigned a standard course name and number for all approved courses.
